TDS is not able to consider ‘setoffs’ or ‘counterclaims’ brought by either party.
We are also unable to consider disputes between tenants over how the deposit is to be distributed.
TDS will only be able to consider the tenant's potential breaches during the tenancy and release the deposit held in line with the adjudicator’s decision.
If there is more than one tenant, the award will be split equally between the tenants.
