The reason I changed from a competitor scheme to yourselves is because their Dispute Resolution Service is very poor and inconsistent. The main failings are the difficulty to submit evidence, the poor decisions by the adjudicators, the ignoring of photographic evidence, the mistakes by the adjudicators in working out unpaid rent (I had to complain to get the correct amount), the losing of evidence and not acknowledging they had received recorded post days after receipt.

What do I need to know as a landlord when protecting a deposit?

Use our handy deposit cap calculator to check your tenancy deposits are in line with the Tenant Fees Act that came into force on 1 June 2019 for English tenancies. Tenancy deposits are capped at the equivalent of 5-weeks’ rent for assured-shorthold tenancies with an annual rent of up to £50,000 or 6-weeks’ rent for tenancies with an annual rent of £50,000 or more.

All landlords are required by law to protect any deposits taken for a tenancy within 30 days of receiving the deposit or within 30 days of the tenancy becoming an assured shorthold tenancy. TDS provides government-approved tenancy protection in England, Wales and Northern Ireland to help you meet your legal requirement. Choose between our free Custodial scheme (where TDS holds the deposit) or our Insured scheme (where you hold the deposit) and pay TDS a small fee to protect it.

Once you have protected your tenancy deposit in one of our deposit protection schemes, TDS will issue you with your prepopulated PI. You must give this to your tenant (and any other person who contributed to the deposit) within 30 days of receipt of the tenancy deposit.

Should a dispute arise either mid-tenancy or end of tenancy we offer free resolution services. As a government approved provider of alternative dispute resolution, TDS offers both a free and impartial mid-tenancy mediation and conciliation service, TDS Resolution, as well as an end of tenancy dispute service. If there is no dispute, release the deposit within 10 working days.
